The Schedule forms part of these Terms & Conditions. If there is an inconsistency, the Schedule prevails to the extent of the inconsistency.
1. Promoter
1.1 The promoter is Foxoff Giveaways Pty Ltd (ABN 22 694 105 907) of PO Box 6169, Shepparton VIC 3632 (Promoter, Foxoff, we, us or our).

2. Acceptance and interpretation
2.1 By participating in the Promotion, each entrant agrees to these Terms & Conditions, the Promotion Schedule, and any specific instructions or entry allocations published on the Promotion page.
2.2 Australian Eastern Time or AET means the time in Melbourne, Victoria, being AEST or AEDT as applicable on the relevant date.
2.3 Immediate family means a spouse, de facto partner, parent, child, sibling, grandparent or grandchild, whether by birth, marriage, adoption or step-relationship.
2.4 A reference to law includes any amendment, replacement, subordinate instrument, regulator direction or mandatory requirement applicable to the Promotion or the Prize.
3. Eligibility
3.1 Entry is open only to natural persons who are aged 18 years or over, ordinarily reside in the Eligible Area and satisfy these Terms & Conditions at the time of entry and at the time the Prize is awarded.
3.2 The following persons are not eligible: (a) directors, officers or persons involved in the management of the Promoter or a benefiting business; (b) persons involved in conducting or determining the winner of the Promotion; (c) employees or contractors of the Promoter, the prize suppliers, promotion agencies or draw provider who are directly involved in the Promotion; and (d) the immediate family of any person in paragraphs (a) to (c).
3.3 The Promoter may require proof of identity, age, residential address, eligibility, payment status and any other information reasonably necessary to verify an entry or prize claim. Documents may be verified with the issuing authority or a verification service, subject to applicable privacy law.
3.4 An entrant who provides false, misleading, incomplete or fraudulent information, tampers with the entry process or otherwise breaches these Terms & Conditions may be disqualified, subject to applicable law and any required regulatory approval.
4. Promotion period
4.1 The Promotion begins and ends at the dates and times in the Schedule. Entries received after the closing time are invalid, regardless of when they were submitted, posted, processed or displayed by a third-party system.
4.2 The Promoter's website server time and payment records will be used to determine when an online entry was received, subject to applicable law.
5. How to enter - purchase method
5.1 During the Promotion Period, an eligible entrant may purchase an eligible Foxoff digital-content, benefits or merchandise package advertised on the Promotion page (Entry Package) at its normal advertised price. Promotional entries are included with the Entry Package at no additional charge; no separate entry fee is charged.
5.2 Each Entry Package may include digital access to Foxoff Radio, Foxoff TV, partner discounts, merchandise discounts, digital products, member benefits and/or other goods or services described on the Promotion page, together with the stated number of promotional entries.
5.3 The number of entries allocated to each Entry Package is the number clearly displayed on the Promotion page or at checkout at the time of purchase, including any valid advertised multiplier or promotional code.
5.4 There is no maximum number of valid entries per eligible entrant unless a specific offer expressly states otherwise.
5.5 A purchase entry is valid only when the order is complete, paid, not fraudulent, and not cancelled, reversed, refunded or charged back before the Prize is awarded. Where a refund, cancellation or reversal is required by law, the related promotional entries may be withdrawn to the extent permitted by law.
5.6 The purchaser must enter using their own accurate contact details. A person may not use another person's identity, payment details or address without lawful authority.
6. Free entry method
6.1 No purchase is necessary to obtain one (1) free entry. An eligible entrant may send one original handwritten entry per envelope to the Free-Entry Address in the Schedule.
6.2 Each free entry must clearly state the Promotion name and the entrant's full legal name, residential address, email address and phone number, and must be received before the Promotion closes. Entries that are illegible, incomplete, printed, photocopied, machine-generated, sent in bulk in one envelope, insufficiently addressed or received late are invalid.
6.3 Each compliant envelope gives the entrant one (1) entry. Postage and any ordinary cost of preparing and mailing the entry are the entrant's responsibility. The Promoter is not responsible for postal delay, loss or damage.
7. Bonus entries, multipliers and promotional codes
7.1 The Promoter may offer limited-time bonus entries, multipliers, loyalty allocations or promotional codes. Each offer is governed by its advertised start and end time, eligibility requirements, entry allocation and any stated limit.
7.2 Where a code is required, it must be correctly entered before checkout is completed. Unless required by law or caused by a verified Promoter system error, the Promoter is not required to retrospectively apply a code, multiplier or offer that the entrant omitted or used outside its advertised conditions.
7.3 If promotional material contains an obvious typographical, display or system error, the Promoter may correct the error and apply the entry allocation that was reasonably intended and otherwise lawfully advertised, subject to applicable law and any required regulator notification.
8. Entry records and invalid entries
8.1 Each valid entry will be recorded and assigned a unique entry number or number range. The Promoter's records are final and binding except in the case of manifest error and subject to applicable law.
8.2 The odds of winning depend on the total number of valid entries received. The Promoter does not guarantee any particular odds or total entry pool unless expressly stated in writing.
8.3 Entries generated by scripts, bots, automated methods, tampering, payment fraud, multiple false identities or other conduct that undermines the fair administration of the Promotion are invalid.
9. Authority, licences and regulatory compliance
9.1 The Promotion is conducted under NSW Trade Promotion Authority No. TP/04959. Any authority, permit or notification reference required by law will be displayed on advertising material and the Promotion page.
9.2 The Promotion is not open in ACT or SA. The Promoter may further restrict entry from a state or territory before the Promotion opens if required for licensing or compliance reasons, provided the change is clearly published and handled in accordance with applicable law.
9.3 If a regulator requires a change, suspension, postponement, redraw or other step, the Promoter may take that step to the extent required or permitted by law and will publish reasonable notice to affected entrants.
10. Prize details and value
10.1 There is one (1) Prize. After verification, the confirmed winner may choose either: (a) the CFMOTO quad bike and Frontline trailer package comprising only the items listed below (Merchandise Option); or (b) the AUD $12,000 cash alternative stated in the Schedule (Cash Option). The winner receives one option only, not both. Images used in advertising may be illustrative and do not add any item that is not listed in these Terms & Conditions or the Promotion page.

10.2 The maximum total prize value is AUD $17,630 including GST, comprising the CFMOTO CFORCE 520 EPS HUNT valued at AUD $11,690 and the custom Frontline quad-bike transport trailer valued at AUD $5,940. The Cash Option has a face value of AUD $12,000.
10.3 Prize values are based on the manufacturer and supplier retail values relied on when these Terms & Conditions were finalised on 9 August 2026 and may change. The winner is not entitled to an additional payment or benefit because an item's market value later increases or decreases, because a dealer offers a discount, or because the winner selects the lower-value Cash Option.
10.4 If an item becomes unavailable, discontinued or cannot reasonably be supplied, the Promoter may substitute an item of equal or greater value, subject to applicable law and any required regulatory approval.
10.5 The right to claim the Prize is personal to the winner and is not transferable before delivery without the Promoter's written approval. After lawful delivery and transfer of title, the winner may deal with the Prize subject to law, warranty conditions and any supplier restrictions that lawfully apply.
10.6 The verified winner must make a final written choice between the Merchandise Option and Cash Option within five (5) business days after the Promoter requests the election. The choice cannot be split or reversed after acceptance. If the winner does not make a valid election by the deadline, the Promoter may deem the Merchandise Option selected. The Cash Option will be paid by electronic funds transfer to an Australian bank account in the winner's name within ten (10) business days after the winner has completed verification and supplied accurate bank details. No additional compensation is payable with the Cash Option.
10.7 The exact vehicle identification number, trailer identification details and model year will be those allocated by the relevant suppliers. Unless expressly listed, accessories, tools, tie-downs, fuel, helmets, riding equipment and items shown in background imagery are not included.
11. Prize supply, delivery, registration and costs
11.1 If the winner selects the Merchandise Option, the quad bike will be supplied through an authorised CFMOTO dealer and the trailer through the relevant Frontline supplier. The Promoter may arrange delivery to one eligible Australian address, delivery to the nearest reasonably accessible dealer or freight depot, or collection by prior arrangement with the winner and suppliers.
11.2 Reasonable standard delivery of the listed Merchandise Option components to one eligible Australian address or nominated accessible collection point is included. Remote-area surcharges, sea freight, redelivery, storage, special handling, optional transit insurance, access equipment, winner-requested upgrades and costs caused by inaccurate delivery information are the winner's responsibility.
11.3 Unless the Promotion page expressly states otherwise, the Prize does not include conditional, restricted or full registration of the quad bike; trailer registration; stamp or motor vehicle duty; transfer fees; number plates; compulsory third-party cover; insurance; licences; permits; helmets; fuel; servicing; maintenance; repairs; or any tax or ongoing ownership cost. Supplier documents ordinarily issued with the new quad bike and trailer will be provided where available.
11.4 The winner must promptly complete any reasonable dealer, supplier, delivery, registration, identity, warranty or ownership documentation. If the winner cannot accept delivery within a reasonable period notified by the Promoter, the parties will make reasonable alternative arrangements, but resulting storage or redelivery costs may be charged to the winner to the extent permitted by law.
11.5 Risk in each Merchandise Option component passes to the winner on delivery or collection. Title passes when any required documentation is completed and the relevant component is lawfully handed over. For the Cash Option, risk in the transferred funds passes when payment reaches the nominated account. This clause is subject to non-excludable rights under Australian Consumer Law.
12. Draw and winner selection
12.1 The electronic draw will occur at 8:30 pm AEST on Sunday 6 September 2026 from the Promoter's business premises in Shepparton, Victoria using the Draw System stated in the Schedule. The winner does not need to be present.
12.2 One provisional winner will be selected at random from all valid entries using the Draw System. The determination will be carried out in the presence and under the supervision of a person independent of the Promoter. The draw will be livestreamed through a Foxoff social-media channel, may also be streamed or republished through other Foxoff channels, and may be recorded and published for transparency and promotional purposes.
12.3 If the stated Draw System is unavailable or materially impaired, the Promoter may use another independent computerised random-selection system that produces a fair random result, subject to applicable law, authority conditions and any required regulator approval or notice.
12.4 The first valid eligible entry drawn is the provisional winner, subject to verification. If that entry is invalid or the entrant is ineligible, the Promoter may conduct a redetermination in accordance with these Terms & Conditions and applicable law.
13. Winner verification and notification
13.1 The provisional winner will be announced during the livestream immediately after the draw and contacted using the phone number and/or email address supplied at entry as soon as practicable and no later than two (2) business days after the draw.
13.2 Before the Prize is awarded, the provisional winner must provide requested proof of identity, age, residency and eligibility, and sign any reasonable receipt, release, delivery, registration or ownership documentation that does not exclude non-excludable legal rights.
13.3 The entrant is responsible for keeping their contact details accurate and monitoring calls, voicemail, email and junk folders. The Promoter will make reasonable efforts to contact the provisional winner.
13.4 The provisional winner is not the confirmed winner until the Promoter has completed verification and confirmed the award in writing.
14. Winner publication
14.1 The provisional winner may be identified during the livestream. After verification, the confirmed winner's first name, surname initial and state or territory may be published on the Foxoff website, social-media channels, livestream, promotional material and any place required by law or an authority condition.
14.2 The winner consents to reasonable photographs, video or audio of the draw, notification and prize handover being used by the Promoter for reporting and promotion without additional compensation, provided the use is lawful and does not materially misrepresent the winner.
15. Prize claim and unclaimed-prize redraw
15.1 The Prize must be validly claimed by 8:30 pm AEDT on Sunday 6 December 2026. A claim is complete only when the winner has responded, passed verification, made any required prize election and supplied all reasonably requested documentation.
15.2 If the Prize remains unclaimed by that deadline, the winner cannot be contacted despite reasonable efforts, the winner is ineligible, or the winner fails to comply with these Terms & Conditions, the Promoter may forfeit the claim and conduct an unclaimed-prize redraw at 8:30 pm AEDT on Monday 7 December 2026 using the method stated in the Schedule, subject to applicable law and any required regulatory approval.
15.3 The redraw will use the same or another permitted independent random-selection system. The replacement provisional winner will be notified and published in the same manner as the original winner.
16. Quad-bike ownership, registration and safe operation
16.1 Selecting, winning or owning the quad bike does not by itself authorise any person to ride or operate it on a road, road-related area, public land, private land or workplace. The winner and every operator are solely responsible for learning and complying with all Commonwealth, state, territory and local laws and landholder requirements.
16.2 The quad bike is designed principally for off-road use. Public-road or road-related-area use may be prohibited or may require conditional, restricted or special-purpose registration, a current driver licence, compulsory cover, specific equipment and compliance with operating conditions. Requirements differ by jurisdiction and intended use and must be checked with the relevant road authority before operation.
16.3 The winner must ensure the quad bike is operated only by a competent and legally authorised person, on suitable terrain, within the manufacturer's instructions and load, towing and operating limits, and with all required permissions, risk controls, protective equipment and supervision.
16.4 The fitted operator protection device must not be removed or misused. Every operator must wear an approved and properly fitted helmet and suitable protective clothing. No passenger may be carried on this single-rider adult quad bike, and a child under 16 must not operate or ride on it.
16.5 The winner is responsible for training, pre-ride inspection, tyre pressure, fuel, battery care, servicing, maintenance, safe storage and transport, and assessing slopes, terrain, weather, loads, attachments and rollover risk. Workplace or commercial use may impose additional work health and safety duties on employers, self-employed persons and operators.
16.6 The Promoter does not provide legal, registration, driving, workplace-safety, hunting or mechanical advice and does not warrant that any proposed use will be lawful, safe, approved, registered or insurable.
17. Trailer registration, loading and towing
17.1 Before the trailer is used on a public road or road-related area, the winner must ensure it is registered or lawfully exempt from registration in the relevant jurisdiction and that all required identification, compliance, lighting, braking, coupling, safety-chain, tyre, dimension and mass requirements are satisfied.
17.2 The winner must use a legally suitable tow vehicle and towbar with adequate towing, tow-ball and load ratings; correctly connect the trailer; secure the quad bike and any other load with appropriately rated restraints; maintain lawful axle, aggregate trailer, tow-ball and gross combination masses; and comply with all road rules and manufacturer instructions.
17.3 No person or animal may travel on the trailer. Loose items must be removed or secured, loading ramps must be secured for travel, and the winner must confirm that the loaded trailer is stable, roadworthy and covered by any legally required or chosen insurance before towing.
17.4 The Promoter does not represent that the trailer or loaded combination can lawfully or safely be towed by every vehicle. Choosing and providing a suitable tow vehicle, driver, registration, insurance and restraints is the winner's responsibility.
18. Manufacturer, supplier and warranty
18.1 CFMOTO, CFORCE, HUNT, Frontline and associated marks are trademarks or business names of their respective owners. Unless expressly stated on the Promotion page, the Promotion is not sponsored, endorsed, administered by or associated with those owners.
18.2 Any manufacturer or supplier warranty applies according to its own commencement date, registration requirements, service schedule, permitted-use rules, exclusions and claim conditions, in addition to any non-excludable rights under Australian Consumer Law. The CFMOTO warranty is described by the manufacturer as two years, subject to its applicable terms.
18.3 Specifications, colours, components, model-year details, supplier lead times and compatible accessories may change under manufacturer or supplier terms. The Promoter is not responsible for a change made after delivery, except to the extent required by law.
19. Refunds, cancellations and chargebacks
19.1 Purchases are governed by the Promoter's website terms, refund policy and Australian Consumer Law. Nothing in these Terms & Conditions excludes a right to a refund, replacement or other remedy that cannot lawfully be excluded.
19.2 Where an order is lawfully cancelled, refunded, reversed or charged back, the promotional entries connected with that order may be cancelled to the extent permitted by law. Fraudulent or abusive chargebacks may result in disqualification and recovery action.
20. Liability
20.1 Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot lawfully be excluded, restricted or modified, including under Australian Consumer Law.
20.2 To the maximum extent permitted by law, the Promoter and its associated entities, personnel, suppliers and contractors are not liable for indirect, special or consequential loss arising from the Promotion or Prize, or for loss caused by an entrant's or winner's unlawful, unsafe, negligent or unauthorised conduct.
20.3 To the maximum extent permitted by law, the Promoter is not responsible for technical failures, internet or platform outages, postal delay, data corruption, unauthorised access, third-party acts or omissions, dealer or freight delay, manufacturer or supplier delay, adverse weather or other events outside its reasonable control.
20.4 The winner accepts the ordinary risks associated with owning, transporting, loading, towing, maintaining and operating a quad bike and trailer, including collision, rollover, crushing, ejection, load shift, mechanical failure and property damage. This clause does not exclude liability that cannot lawfully be excluded.
21. Privacy and communications
21.1 The Promoter collects personal information to administer the Promotion, process entries, prevent fraud, verify eligibility, conduct the draw, notify and publish the winner, arrange supply and delivery, comply with legal obligations and respond to enquiries.
21.2 Information may be disclosed to the draw provider, payment processors, professional advisers, regulators, prize suppliers, dealers, freight providers, verification providers and service providers where reasonably necessary for those purposes or required by law.
21.3 Marketing communications will be sent only in accordance with applicable law and the entrant's consent or existing relationship. Entrants may use the unsubscribe method in a message, but unsubscribing does not remove an otherwise valid entry or prevent essential Promotion communications.
21.4 Personal information is handled under the Promoter's Privacy Policy available on its website. Entrants may contact the Promoter to request access or correction, subject to law.
22. Social-media platforms
22.1 Unless expressly stated otherwise, the Promotion is not sponsored, endorsed, administered by or associated with Facebook, Instagram, Meta, TikTok, YouTube or any other social-media platform.
22.2 To the extent permitted by law, each entrant releases those platforms from claims arising solely from the administration of the Promotion. Entrants must also comply with the platform rules applicable to their own use.
23. Disputes and complaints
23.1 An entrant who believes an entry, allocation, draw or prize decision is affected by error should contact info@foxoffgiveaways.com.au with supporting details as soon as reasonably possible.
23.2 The Promoter will review the matter in good faith, check available records and provide a written outcome where appropriate. This process does not limit any right to contact a regulator, consumer affairs body or court.
23.3 The Promoter's decision is final on factual and administrative matters, subject to applicable law, manifest error and regulator direction.
24. Changes, suspension or cancellation
24.1 The Promoter may amend, suspend, postpone or cancel the Promotion only where reasonably necessary because of fraud, technical failure, legal or regulatory requirements, supplier failure, force majeure or another circumstance outside the Promoter's reasonable control, and only to the extent permitted by law.
24.2 Any material change will be notified to the relevant regulator where required and published to entrants within a reasonable time. The Promoter will not reduce an already advertised prize value or materially disadvantage entrants without lawful authority or required approval.
25. General
25.1 If a provision of these Terms & Conditions is invalid or unenforceable, it will be read down to the minimum extent necessary or severed, without affecting the remaining provisions.
25.2 A failure or delay by the Promoter to exercise a right is not a waiver of that right.
25.3 These Terms & Conditions are governed by the laws of Victoria, Australia. Entrants submit to the courts of Victoria, without excluding the operation of mandatory laws in another Australian jurisdiction that cannot lawfully be displaced.
25.4 Headings are for convenience only. Singular includes plural and vice versa. "Including" means "including without limitation".
